WAIVER/AGREEMENT
In consideration of your acceptance of my child’s registration, I agree that Origami Rhythmics gymnastics club(“Origami Rhythmics”) and its instructors, coaches, directors, officers and contractors shall not be liable for any claim, demand, cause of action of any kind whatsoever for, or on account of personal injury, property damage or loss of any kind resulting from or related to my child’s use of the facilities or participation in any program, exercise or activity within or outside the premises, including transportation, and I agree to the Origami Rhythmics gymnastics club (“Origami Rhythmics”) and its instructors, coaches, directors, officers and contractors to hold harmless from the same.
*All medical expenses incurred will be the responsibility of the child’s family.
SOCIAL MEDIA
Origami Rhythmics Gymnastic Club reserves the right to post photos/videos from training, competitions & events onto Origami Rhythmics social media platforms, and Origami Rhythmic’s club websites.
REGISTRATION & PAYMENT POLICIES
- All e-transfers must include the following: child's name, payment details e.g. September classes fee
- All Competitive Programs are a seasonal commitment from September 5th, 2023 to June 23, 2024.
- All Recreational & Performance programs must submit fees every 2 months.
- All fees are due on the 1st of the month. Payments not made on the 1st of the month will be charged a $25 late fee.
- Any additional payments for special events and competitions will be sent out prior to each event with due dates.
- Parents must submit either post dated cheques, e-transfers or cash payments to avoid late fee charges.
- After 7 days of late payment the gymnast will not be allowed to continue training until all fees are up to date.
- If a gymnast misses more than 2 consecutive weeks of classes without a valid reason, e.g. to sickness, or injury, they must
re-register with the club.
CANCELLATION & REFUND POLICIES
- Enrolment in an annual, summer and all other programs is a commitment to pay an entire tuition amount. Tuition is nonrefundable, non-transferable and no refunds or credits will be given for missed classes or early withdrawal from the program.
- If any applicable laws, including but not limited to orders of the provincial health officer, prevent in-studio training, or if Origami Rhythmics deems it unsafe to carry out in-studio training, I agree that material changes in delivery of any programs will not entitle me to a refund.
- Students who must discontinue training prior to the end of the school year for any reason must notify the management in writing. In all cases, a student must notify the management if he/she is unable to attend class.
- In the event of a missed class due to an unforeseen class cancellation by the club, make-up classes will be offered.
All make-up classes must be approved by the Origami management prior to their attendance.
PARENTS COMMITMENTS & VOLUNTEERING
- Parents are expected to bring their child to a training session 10 minutes prior to the training session to allow their child changes and is ready for training on time.
- When classes are completed all gymnasts must leave promptly and NO LATER than 15 minutes after the practice has ended. If parent/guardian fails to pick up their child after the practice, they will be charged $20 for every 15-minute increment (starting after the 15-minute grace period).
- Parents are encouraged to volunteer a minimum of 6 hours throughout the season at multiple events hosted by Origami Rhythmics. Please contact the club director Lena regarding volunteering opportunities and schedule
MISSED CLASSES
- If a gymnast shows any signs of sickness, they must not attend the class. In the case a gymnast showing the symptoms of a flu: cough, fever, stomach-ache, they must report it to their coach or the club ASAP 778-863-4187.
- Make-up classes must be coordinated with the coach and club management. Make-up classes must be taken within 2 weeks of a missed class.
TERMINATION OF MEMBERSHIP
Origami Rhythmics reserves the right to terminate the Participation Membership of any participant immediately if he/she fails to comply with rules and regulations of Origami Rhythmics, if he/she engages in other conduct that is detrimental to the health or safety of the coaches, other gymnasts, or if the parent/guardian fails to pay program fees or other amounts that are due to Origami Rhythmics. Upon termination or cancellation of the membership, the participant will remain liable for any other outstanding dues or other charges owed. Origami reserves a right to collect any outstanding payments via all legal means.
PERMANENT MEDICAL DISABILITY OF A MEMBER
- In the event that the participant is permanently unable to exercise due to a medically documented condition, Origami Rhythmics will require a signed letter from the gymnast’s physician detailing the medical reason for cancellation of the Agreement. Once certified, the Participation Agreement will be terminated as of the date Origami Rhythmics receives valid documentation of permanent disability. No retroactive medical refunds will be issued.
NOTICE OF CONSUMER RIGHTS
- Origami Rhythmics is not bonded because it does not collect more than three months advance
payment.
2. You are entitled to a copy of this waiver/agreement. You have the right to cancel the Agreement within three business days after receiving your copy. To cancel this Agreement, you must give Origami Rhythmics written notice of the cancellation.
- In the event Origami Rhythmics is completely closed for one month or more due to fire, flood, or other event that is out of the control of Origami Rhythmics, Origami Rhythmics will at its option, either: 1) Offer on-line classes for the duration of the remaining program. 2) provide credit for the missed classes and offer make up classes after reopening. In case the gymnast decides to leave the program, the credit expires and has no cash value. No refunds will be offered.
ENTIRE WAIVER/AGREEMENT
You acknowledge that, except for what is contained in this WAIVER/AGREEMENT, Origami Rhythmics has not made any promises, representation or warranties to you. By signing below you agree to all terms and conditions of this agreement.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT
(hereinafter the “Release Agreement”)
BY SIGNING THIS RELEASE AGREEMENT, YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF THE OCCUPIERS LIABILITY ACT OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT PLEASE READ CAREFULLY!
TO: BCRSGF AND ALL MEMBER CLUBS and their respective directors, officers, employees, members, participants, coaches,
volunteers, agents, independent contractors, subcontractors, representatives, successors, and all owners, operators or
occupiers of the facilities in which the rhythmic gymnastics activities, as defined below, take place (all of whom are hereinafter
collectively referred to as the “Releasees").
DEFINITIONS
In this Release Agreement, the term "rhythmic gymnastics activities" shall include all orientation, training, instruction,
supervision, competitions, programs, services, and use of facilities and equipment which are organized, provided, controlled or
conducted by the Releasees.
ASSUMPTION OF RISKS – Rhythmic gymnastics activities involve various risks, dangers and hazards, which can result in serious injuries and death. These risks, dangers and hazards are reviewed in detail in the BCRSGF. website at: http://www.rhythmicsbc.com/#1505606959328-84344a1c-7b16 Please take the time to learn about the risks, dangers and hazards of participating in rhythmic gymnastics activities by carefully reviewing the Health and Safety, Assumption of Risks, and Risk Management sections of the BCRSGF website. Exposure to infectious disease including COVID-19 is one of the risks of participating in rhythmic gymnastics activities. Specific information regarding the response of BCRSGF and member clubs to the COVID-19 pandemic is found in the Public Health section of the website. If you are a parent or guardian of a participant under the age of 19, please educate your child on these risks, dangers and hazards before completing this form. All participants in rhythmic gymnastics activities are required to assume all such risks, dangers and hazards and all injuries resulting therefrom.
I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH RHYTHMIC GYMNASTIC ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT (applies to person 19 years of age and older) In consideration of THE RELEASEES allowing me to participate in gymnastics activities, I hereby agree as follows:
1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in gymnastics activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c. 337, ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN RHYTHMIC GYMNASTICS ACTIVITIES;
2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury
to any third party resulting from my participation in gymnastics activities;
3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and
representatives, in the event of my death or incapacity;
4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be
governed by and interpreted solely in accordance with the laws of British Columbia and no other jurisdiction; and
5. Any litigation involving the parties to this Release Agreement shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of gymnastics activities, other than what is set forth in this Release Agreement. I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
